Terms of Service

These Terms of Service (“Terms”) govern your use of the TexScape mobile application and website located at TexScape.app (collectively, the “Service”), operated by CoachWare AI, LLC (“CoachWareAI,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use TexScape. By using the Service, you confirm that you meet this requirement. If you are between the ages of 13 and 18, you represent that you have your parent or guardian’s permission to use the Service. We reserve the right to terminate accounts found to be in violation of this requirement.

2. Acceptable Use

TexScape is designed for personal, lawful use — including scheduling discreet SMS messages for safety purposes, graceful social exits, and time-delayed personal communications. You agree that you will not use the Service to:

  • Send unsolicited, bulk, or commercial SMS messages (spam).
  • Harass, threaten, or harm any individual.
  • Impersonate another person or entity.
  • Violate any applicable local, state, national, or international law or regulation, including carrier messaging policies.
  • Attempt to circumvent, disable, or interfere with the security or functionality of the Service.
  • Use the Service for any purpose that could expose CoachWare AI, LLC to legal liability.

We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have violated these Terms.

3. SMS Delivery

TexScape delivers SMS messages via Twilio, our third-party SMS provider. By using the Service, you acknowledge and agree that:

  • SMS delivery depends on your carrier, the recipient’s carrier, and network availability. Delivery is not guaranteed.
  • Message and data rates may apply based on your mobile plan.
  • You are solely responsible for ensuring that any recipient of your messages has consented to receive them where required by applicable law.
  • We are not liable for delays, failures, misdirected delivery, or any costs incurred as a result of carrier or network conditions beyond our control.

4. Credits

TexScape uses a credit-based system to access certain features of the Service.

  • Credits are deducted from your balance at the time a message is scheduled, not at the time of delivery.
  • Credits are refunded to your balance if you manually cancel a scheduled message before it sends, or if a scheduled message is detected as orphaned on app relaunch (i.e., the scheduled send time passed while the app was not running).
  • Credits used for messages that have been successfully sent are non-refundable.
  • All credit pack purchases are final. We do not offer refunds on purchased credits under any circumstances, including unused credits remaining in your account at the time of account closure or termination.
  • We reserve the right to modify credit costs, credit pack pricing, and credit caps at any time, with reasonable notice provided through the app or website.

5. Refer-a-Friend Program

TexScape offers a refer-a-friend program through which you may earn bonus credits for referring new users to the Service.

  • Referral rewards are issued to the referring user only when the referred user completes their first actual use of the Service (sending or scheduling a message). Installation or account creation alone does not qualify.
  • Referral rewards are subject to monthly caps: Basic users may earn rewards for up to 3 successful referrals per calendar month; Premium users may earn rewards for up to 10 successful referrals per calendar month.
  • Each referral code may only be used once per referred user. Duplicate or fraudulent referral submissions will be disqualified.
  • We reserve the right to modify, suspend, or terminate the referral program at any time, with or without notice, and to withhold or reverse rewards obtained through abuse or fraud.
  • Referral credits have no cash value and cannot be transferred, sold, or exchanged.

6. Premium Tier

CoachWare AI, LLC intends to offer a Premium subscription tier for TexScape with enhanced features and higher credit caps. Premium is not yet available. When Premium launches:

  • Separate pricing, terms, and conditions will apply and will be presented to you before purchase.
  • You may opt in to be notified when Premium becomes available. Opting in does not constitute a purchase or commitment.
  • All Premium purchases, once made, are subject to the no-refund policy described in Section 4.

7. Opt-Out and Support

If you receive a TexScape-delivered SMS and wish to stop receiving messages, you may reply STOP at any time. For assistance, reply HELP or contact us at .

Note: Opting out via STOP applies to carrier-level message delivery. It does not delete your TexScape account or scheduled messages. To manage your account, open the TexScape app directly.

8. Intellectual Property

All content, design, code, trademarks, and materials associated with TexScape and CoachWare AI, LLC are the property of CoachWare AI, LLC or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our express written permission.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, CoachWare AI, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:

  • Failure or delay in SMS delivery.
  • Loss of data or account access.
  • Unauthorized access to your account or messages.
  • Any reliance on the Service for safety-critical communications.

In no event shall our total liability to you exceed the amount you paid to CoachWare AI, LLC in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless CoachWare AI, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms from time to time. For significant changes, we will notify you via in-app notification or email prior to the change taking effect, and will require your affirmative acknowledgment where required by applicable law. The “Last updated” date at the top of this page will always reflect the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
